1. Tour Services, Registration

The scope of contractual services offered during the motorcycle tour is described in the respective pages of the catalogue / advertisement. Additional services are not accounted for by either Schönbrunn Reisen or Moto Adventures. The written registration of the particpant is the conclusion of a binding contract between the participant on the one hand and Schönbrunn Reisen /Moto Adventures on the other hand. Registrations of a participant are also valid for other persons he/she is signing up for. In this case, the participant is not only responsible for his own contractual obligations, but also for the contractual obligations of the persons he/she signed up for, if the participant assumed a corresponding obligation in combination with an explicit and seperate declaration thereof. The tour contract becomes effective with the written confirmation of the registration issued by Schönbrunn Reisen. Should the contents of the confirmation differ from the contents of the registration, a new offer is forwarded by Schönbrunn Reisen/Moto Adventures with a 10 day period of commitment. The new contract on the basis of the new offer becomes effective with the participant's approval within the period of commitment.

2. Price, Mode & Terms of Payment, Travel Documents

No claims regarding the provision of services by Moto Adventures can be made without having effected full payment of the tour. After thethe registration the participant will receive a tour contract of Schönbrunn Reisen with a booking confirmation and a travel security note. A 10% advance payment, but not more than Euros 350 per particpant is due upon receipt of these documents. The remaining price is due 36 days before the tour starts at the very latest. If bookings are made 35 days or less before the tour begins, then the entire price of the tour must be paid upon receipt of the travel security note. The remaining travel documents will then be forwarded upon receipt of payment. If payment is effected shortly before the tour starts, the participant must bear all costs arising from an express transfer of the documents, inasfar as the delay in payment is accounted for by the particpant. Schönbrunn Reisen Ltd. may request the remaining amount - apart from the 10% prepayment and Euros 350,-- - before the tour begins, if it has ensured that all participants will be reimbursed for services that cannot be offered and refunded for necessary home journeys in the case of illiquidity, default or insolvency of the tour operator. Schönbrunn Reisen has secured its own risk of insolvency accordingly. The travel security note guarantees the fulfillment of the particpants' direct claims in the case of illiquidity, default or insolvency. Schönbrunn Reisen and Moto Adventures are entitled to decline services and to claim compensation for non-fulfillment of contract if the particpant fails to effect payment on time after Schönbrunn has announced its decline of services with an additional respite in accordance with the legal regulations in written form. Particpation fees and prices are listed in the respective travel documents.

3. No. of Minimum Participants

We can only offer the tours if a minimum of bookings is reached. Normally, 5 particapants must have signed up for a tour through Europe. If we do not reach 5 bookings four weeks before thet our begins, the tour will have to be cancelled. In this case, you will be informed immediately and all payments
returned. We can not cover any cancellation fees for bookings that were not made through us. The maximum number of motorcycles per group is 8.

4. Changes in Itinerary, Price increases

Changes in the itinerary are only permitted if these changes are not lead through deliberately or if they deviate strongly from the original itinerary. Eventual guaranty claims are unaffected insofar as the changes in services are afflicted with deficiencies. Motor Press Stuttgart and Gravel Travel are authorized to increase the tour costs, if the following components of the prices are increased or if costs arise after the conclusion of the contract that could not have been anticipated by Schönbrunn Reisen/Moto Adventures and which cannot be replaced by Schönbrunn Reisen or Moto Adventures: Exchange rates, public charges, taxes and other public fees including flight and security charges. However, a price increase is only admissable if the period of time between the conclusion of the contract and the beginning of the tour exceeds 4 months. Should this be the case, the participants will be informed thereof 3 weeks before the tour takes place. No price increases are admissable after that. A price increase of over 5% of the tour price authorizes the participant to cancel the tour without being charged any cancellation fees. The participant can request participation in an equivalent tour, if Schönbrunn Reisen/Moto Adventures are in a position to offer such a trip without having to bear additional expenses. Participants should claim their rights immediately in written form when being informed about a price increase or a change in itinerary by Schönbrunn Reisen/Moto Adventures.

5. Cancellations, Replacements, Rebookings, No Shows

The participant can cancel the tour before it begins. He can also be replaced by another person. However, Schönbrunn Reisen / Moto Adventures can disagree with the replacement of the original participant if the replacing person does not fulfill the necessary requirements for participating in the tour of if the replacement does not fulfill the legal requirements stipulated by the countries or by the authorities in the respective countries. If a participant is replaced by a third party, then the participant and the third party are liable to Schönbrunn Reisen/Moto Adventures for the full payment of the tour as well as for any additional costs arising from the replacement. The date of receipt of the cancellations and other documents including statements is relevant for deadlines. Cancellations and other documents in written form referring to the tour must be conveyed to Schönbrunn Reisen and Moto Adventures in written form and the date of receipt is used to calculate the cancellation fees and charges. In the case of cancellation, administrative fees of at least Euros 25,-- per person are invoiced. Additionally, Schönbrunn Reisen / Moto Adventures are entitled to the following payments in the case of cancellation:

- cancellation 60 days before the tour: 10% of the tour price, minimum ofEuros 25,--
- cancellation 28 days before the tour: 25% of the tour price
- cancellation on the day of the tour or in the case of a no show: 100%

These payments are lump sum compensations inasfar as Schönbrunn Reisen/Moto Adventures do not prove that the remaining claim for reimbursement would have been higher than it would have been after a deduction of the saved expenses. The participant is free to prove that a lower damage or no damage at all has arisen for Schönbrunn Reisen/Moto Adventures.

If a particpant does not appear or if a participant is delayed for the tour or delayed for departures, arrivals, or if the particpant cancels the tour on the day the tour begins or if the participant cancels the trip with reasons not to be justified by Schönbrunn Reisen/Moto Adventures or if the participant must be excluded from participating or continueing the tour, then Schönbrunn Reisen/Moto Adventures will claim all costs. All costs arising from the transport of the participant to his/her travel destination are to be covered by the participant. Reimbursements will only be effected inasfar as Schönbrunn Reisen themselves are reimbursed for services that have not been consumed. Rebookings of the participants which exceed the deadlines listed above can - as far as new bookings can be led through - only be processed by cancellation and a new booking. This is not necessary for rebookings generating marginal costs only.

6. delays, Exceptional Circumstances

Should the tour be aggravated, jeopardized or hindered by means out of control such as a force majeur without having been able to be anticipated, then Schönbrunn Reisen/Moto Adventures as well as the particpants have the right to cancel the contract. If the contract is cancelled, Schönbrunn Reisen/Moto Adventures canb demand adequate compensation for the services already rendered or for the services still to be rendered until the tour is finalized.

Schönbrunn Reisen/Moto Adventures is obliged to implement necessary measures in such cases, especially if the contract includes the arrangement to transport the participants back home. The additional costs for transportation back home in such cases are to be shared by both parties 50:50. In general, additional expenses are to be carried by the participant.

7. Documents, Passports, Currency, Customs & Health Regulations

The participant is obliged to declare any specifics relating to his/her person and the persons accompanying him/her with regards to these points. Every participant is responsible for following and adhering to the regulations of the respective countries. Any drawbacks arising from disobeying the rules and regulations are accounted for by the participant, unless culpably misinformed by Schönbrunn Reisen/Moto Adventures.

8. Liability, Obligation to Co-operate, Demand for Remedy

The participant can demand compensation for non-fulfillment of the contract, unless the defficiencies cannot be accounted for by Schönbrunn Reisen/Moto Adventures. The participant is obliged to aid and support the tour in the case of sudden interferences or disturbances. The tour guides are to be notified of complaints immediately. Should a tour guide not be available, the compliants are to be forwarded to Schönbrunn Reisen/Moto Adventures immediately. Before cancellation, Schönbrunn Reisen/Moto Adventures are to be given an adequate amount of time for remedy, unless remedy proves to be impossible, and unless Schönbrunn Reisen/Moto Adventures rejects remedy or unless the immediate cancellation of the contract by the participant is justified. Claims for impairment or compensational claims can be asserted within one month after the tour ends at Schönbrunn Reisen/Moto Adventures. After this deadline, claims can only be asserted by participants who have been hindered to meet the deadline independant of negligence. Claims are time barred after 2 years. The limitation of time starts with the last day of the tour in accordance with the itinerary. If the client has asserted claims, the period of limitation is suspended until the date Schönbrunn Reisen/Moto Adventures rejects the claims in written form.

9. Participant Assurances

The participant assures to be the bearer of a valid drivers license. The participant drives at his/her own risk and participates in the event with his own motorcycle (unless travelling with a rented motorcycle) which is admitted to the public traffic and which is in a secure driving condition. The regulations of the STVO and STVZO (Road Traffic Acts) of the respective countries are applied and the legal requirements of an auto liability insurance and an motor own damage insurance must be accounted for by the participants. No additional insurances are covered by Schönbrunn Reisen/Moto Adventures (unless travelling with rented motorcycles). The participant assures to participate in the event with protective clothing (Helm, outerwear, gloves, boots). Recommendations and minimum standards for protective clothing are enclosed with the documents of participation or can be requested seperately.

10. Adhering to Instructions

Should a participant violate against protective regulations or should other participants or the orderly realization of the event be endangered, injured or damaged in any way, the representatives of Schönbrunn Reisen/Moto Adventures are entitled to dismiss the respective participant without granting him/her any reimbursements of the amounts paid. Incurred expenses are not covered by the tour operator and the respective participant is obliged to cover these expenses.

11. Tour Guides (Instructors)

The tour guides (instructors) are not entitled to make legal statements on behalf of Schönbrunn Reisen.

12. Liability

The participant must follow public traffic regulations in all countries. The manner of driving, specifically the driving speed, must be adjusted to the circumstances of the driving route. It is explicitly pointed out that each participant is responsible for his/her own manner of driving and thus for all damages caused by his/her manner of driving, regardless of whether another participant or a third party is involved. The participant carries all legal consequences arising from traffic violations or accidents. The participant confirms to accept this liability and confirms to have sufficient insurance coverage for such cases by signing the contract. Liability for deliberate damages and gross negligence by Schönbrunn Reisen/Moto Adventures and its employees remains unaffected thereof. Insofar as Schönbrunn Reisen/Moto Adventures and its employees obtain services from auxiliary persons or third parties, Schönbrunn Reisen/Moto Adventures are only liable for the diligent recruitment and standard supervision. The liability against participants for the compensation of claims in accordance with the contractual obligations of the contract is limited to the triple tour price, excluding physical damages inasfar as a) the damage was not induced deliberately or with gross negligence on behalf of the participant or b) if Schönbrunn Reisen/Moto Adventures is only responsible for the damages affecting the participants because of defficiencies on behalf of the service provider. Schönbrunn Reisen/Moto Adventures are not liable for disturbances in the provision of services if these services have been booked or recommended as external services (sport events, helicopter trips, theaters, exhibitions etc.) and if these services have been explicitly identified to be external services in the travel documents and booking confirmations, so that it can clearly be seen that these services are not an integral part of the tour services offered by Schönbrunn Reisen/Moto Adventures. Claims for damages against Schönbrunn Reisen/Moto Adventures are limited or barred up to the extent that, based on international agreements and regulations that are applied to the provision of services by service providers, the assertion of claims against service providers can be limited to specific conditions or underly certain restrictions or be barred. Should Schönbrunn Reisen/Moto Adventures be in the position of acting as a contractual air carrier, then its liability is regulated by the regulations of aviation in combination with the international agreement of Warshaw, Den Haag, Guadalajara or the Montreal Agreement (only for flights to the U.S. and Canada). According to the Warshaw agreement the liability of the air carrier is usually limited to cases of death, physical damage and for loss/damage of luggage. Inasfar as Schönbrunn Reisen/Moto Adventures acts as a service provider in different fields, its liability corresponds to the prevailing regulations of the respective field.

13. Insurance for the Coverage of cancellation fees

We recommed an insurance which covers any cancellation fees.

14. Miscellaneous

Court of jurisdiction for claims is Vienna. Ineffectiveness of single clauses of the tour contract do not implicate ineffectiveness of the entire contract. In fact, both parties are obliged to find an arrangement which is closest to the original version.
